On 09.04.2019 ELA’s representatives, lawyers LousinehHakobyan and Tigran Yegoryan conducted training for lawyers practicing in Armenia and the representatives of the RA State Migration Service upon the invitation of the UNHCR on the topic of writing quality cassation appeals in the context of the procedures for determining the refugee status.
In the course of the training ELA’s Senior Legal Adviser Tigran Yegoryan first spoke about the procedural and admissibility aspects relevant to the submission of cassation appeals in this area. He then described the structural and other requirements that a quality cassation appeal should meet. Finally, on the basis of a case study Mr Yegoryan described how best the cassation appeal should reflect the relevant legal bases and be well-reason in general.
LousinehHakobyan presented some of the positions of the judgments of the European Court of Human Rights relevant to the cases of asylum seekers/refugees. In particular, she spoke about the cases relevant to the sharing of the burden of proof in determining the general situation of the state of origin and the asylum seeker’s personal circumstances.
